An Okitipupa Customary Court has dissolved the 23 years old marriage between Mr. John Akinbila and Mrs. Morohunmubo Akinbila on the grounds of provocation, threatening of life with machete , public disgrace and lack of love .
The petitioner, Mrs. Morohunmubo Akinbila was able to discharge the burden of proving that she had long suffered and endured for 10 years and therefore cannot continue any longer.
The claims which the respondent, Mr. John Akinbila was unable to rebut even though he was given the opportunity but failed and neglected to do so.
The marriage is blessed with four issues who are now adults except the fourth child.
In his judgement, the President of the three member panel, Mr. Adedeji O. Adebisi said since all efforts to reconcile both parties by the court has failed, not granting the petitioner’s prayers may lead to further exceptional hardship and depravity.
“Its worthy of note that the court cannot compel unwilling and suffering party in a marriage to continue suffering in the marriage, more particularly when the party responsible for the suffering has not successfully been able to rebut the fact that the petitioner is suffering under him”, he said.
Adedeji added that since the children of the marriage are adults except the fourth child, the dissolution of the marriage would not change much about the current situation and position in life.
On the whole, Mr. Adedeji ruled that the marriage is hereby dissolved and the petitioner shall return the sum of #2,500 as dowry to the respondent through the court.
